  1. Acceptance of these terms

Welcome to Lisbon Buyer’s Agent (“we”, “us”, “our”, or the “Company”), a brand operated by Smiling Dolphin, Lda. By accessing or using the website https://www.lisbonba.com (the “Site”), you agree to be bound by these Terms of Use (the “Terms”). If you do not accept them, please do not use the Site.

We may update these Terms from time to time. Any changes take effect as soon as they are posted on the Site, and your continued use of the Site after that point means you accept the revised Terms.

  1. What we do

Lisbon Buyer’s Agent represents buyers — and only buyers — who are looking to purchase property in Lisbon and the surrounding region of Portugal. Our work typically includes:

  • Searching for and shortlisting suitable properties
  • Analysing the market and assessing individual properties
  • Arranging and attending viewings on your behalf
  • Representing you in negotiations
  • Coordinating legal and tax guidance through trusted professionals
  • Managing the purchase process from offer to completion
  • Supporting you after the purchase is complete

The Site itself gives you information about these services, insights into the Lisbon market, and a way to book a consultation.

  1. Who can use the Site

You must be at least 18 years old to use the Site or to engage our services. By using the Site, you confirm that you meet this requirement and that you have the legal capacity to enter into a binding contract.

  1. Information you give us

When you submit details through the Site — for example, when booking a consultation or sending an enquiry — you agree to:

  • Give accurate, current and complete information
  • Keep that information up to date
  • Keep any access credentials secure
  • Take responsibility for activity carried out using your details
  • Tell us straight away if you suspect any unauthorised use

We may suspend or withdraw access where these Terms are breached.

  1. Intellectual property

Ownership. Everything on the Site — including text, graphics, logos, images, photographs, video, audio, data and the way it is all put together (the “Content”) — belongs to Smiling Dolphin, Lda. or its suppliers, and is protected by Portuguese and international copyright, trademark and other laws.

Limited licence. We grant you a limited, non-exclusive, non-transferable and revocable licence to view and use the Site and its Content for your own personal, non-commercial purposes. This licence does not allow you to:

  • Copy, change, distribute, republish, sell, license or create derivative works from any Content
  • Use data-mining, robots, scraping or similar extraction tools on the Site
  • Use the Site to build a competing or similar service

Trademarks. “Lisbon Buyer’s Agent” and the related logos and marks belong to the Company. You may not use them without our prior written permission.

  1. How you may use the Site

You agree not to use the Site to:

  • Break any applicable local, national or international law
  • Post or send anything unlawful, threatening, abusive, defamatory, obscene or otherwise objectionable
  • Pretend to be another person or organisation, or misrepresent a connection with one
  • Disrupt or interfere with the Site or the servers behind it
  • Collect or store other people’s personal data without their consent
  • Introduce viruses, malware or other harmful code
  • Do anything that could damage, disable or impair the Site
  1. Privacy and data protection

Your use of the Site is also covered by our Privacy Policy, which forms part of these Terms. We handle personal data in line with the General Data Protection Regulation (GDPR) and Portuguese data protection law. By using the Site, you agree to your information being handled as set out in that policy.

  1. Consultations and service agreements

Free consultation. Our initial consultation is offered for information only. It does not create a client relationship or commit either side to anything. Consultation length is 45 minutes.

Service packages. Details of our packages (Essentials, Prestige and Premium Advisory) are provided as a guide. Engaging our services requires a separate written Service Agreement, which will set out:

  • The scope of the work
  • Fees and payment terms
  • Duration and how the agreement can end
  • What each party is responsible for
  • Confidentiality arrangements

No guarantee. We work hard on your behalf, but we cannot promise that you will find a particular property or that any purchase will complete. The final decision is always yours, and we are not responsible for the choices you make.

  1. Third-party links and services

The Site may link to websites or services we do not own or control. We are not responsible for their content, privacy practices or conduct, and we are not liable for any loss or damage arising from your use of them. Following such links is at your own risk.

  1. Financial and legal disclaimer

Not professional advice. Anything on the Site is general information only. It is not legal, financial or tax advice, and you should speak to a suitably qualified professional before making any purchase or investment decision.

Working with specialists. We coordinate with lawyers, tax advisers and other specialists, but we do not provide legal or tax services ourselves. Our team holds the real estate licensing required under Portuguese law.

Changing conditions. Property values, market conditions, tax rules and regulations all change over time. Past trends are not a reliable guide to future outcomes.

  1. No warranties

The Site and its Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. In particular, we do not promise that the Site will run without interruption or error, that faults will be fixed, that it is free of harmful components, or that the information on it is accurate, complete or current.

  1. Limitation of liability

To the fullest extent allowed by law, Lisbon Buyer’s Agent and Smiling Dolphin, Lda., together with their officers, directors, employees, agents and affiliates, will not be liable for any indirect, incidental, special, consequential or punitive damages — including loss of profits, data, goodwill or other intangible losses — arising from your use of, or inability to use, the Site, from any third-party content or conduct on it, from content obtained through it, or from unauthorised access to your data. Where local law does not allow certain exclusions or limitations, our liability is limited to the maximum extent that law permits.

  1. Indemnity

You agree to defend, indemnify and hold harmless Lisbon Buyer’s Agent and Smiling Dolphin, Lda., and their officers, directors, employees, agents and affiliates, from any claims, liabilities, damages, losses, costs or expenses (including reasonable legal fees) arising from your breach of these Terms, your breach of anyone else’s rights, your use of the Site, or any content you submit through it.

  1. Governing law and disputes

These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles. Any legal action relating to these Terms or the Site will be brought exclusively before the competent courts of Portugal, and you agree to submit to their jurisdiction. Before starting any legal action, you agree to try to resolve the matter in good faith; if it cannot be resolved within thirty (30) days, either party may pursue legal remedies.

  1. Suspension and termination

We may suspend or end your access to the Site at any time, without notice, where these Terms are breached or for other reasonable cause. On termination, your right to use the Site ends immediately. Any provisions that by their nature should continue — such as those on ownership, disclaimers, indemnity and limitation of liability — will survive.

  1. Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be adjusted only as far as needed to make it valid, or removed if that is not possible. The remaining provisions stay in full effect.

  1. Waiver

If we do not enforce a particular right or provision, that does not waive it or any other right, and it does not prevent us from enforcing it later.

  1. Entire agreement

These Terms, together with our Privacy Policy and any Service Agreement you sign, make up the entire agreement between you and us regarding the Site, replacing any earlier understandings on the subject.

  1. Assignment

You may not transfer your rights under these Terms without our written consent. We may transfer ours at any time without restriction.

  1. Events beyond our control

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural events, war, terrorism, civil unrest, fire, flood, accidents, pandemics, strikes, or shortages of labour, materials or energy.

  1. Language

These Terms are written in English. If they are translated, the English version prevails in the event of any inconsistency.
